FDA 21 CFR 701.20 Regulatory SOP: True Cold-Process Soap vs. Synthetic Detergent Bars
- Maintains strict compliance with 21 CFR 701.20 where >90% of nonvolatile matter consists of alkali salts of fatty acids.
- Enforces Fair Packaging and Labeling Act (FPLA) dual net weight declarations (4.5 oz / 128 g) on the Principal Display Panel (PDP).
- Provides voluntary 100% descending-order INCI & common-name botanical ingredient disclosure on every paperboard unit carton.
- Restricts therapeutic/drug claims to maintain clean soap and cosmetic regulatory boundaries.
1. Regulatory Scope & Legal Definition (21 CFR 701.20)
Most mass-market "beauty bars" and "body bars" sold in supermarkets are legally classified as synthetic detergent cosmetics rather than true soap because they replace saponified plant oils with petroleum-derived surfactants such as Sodium Lauroyl Isethionate, Cocamidopropyl Betaine, or Sodium Lauryl Sulfate (SLS).
Under Title 21 of the Code of Federal Regulations, Section 701.20 (21 CFR 701.20), a product is legally defined as Soap only when all three statutory conditions are met:
- Composition: The bulk of the nonvolatile matter in the product consists of an alkali salt of fatty acids and the detergent properties of the article are due to the alkali-fatty acid compounds.
- Labeling & Representation: The product is labeled, sold, and represented solely as soap (or cosmetic moisturizing cleanser where full
21 CFR 701.3INCI labeling is provided). - Zero Unapproved Drug Claims: The product makes no antimicrobial, antiseptic, eczema-curing, or dermatological drug claims that would reclassify it as an Over-The-Counter (
OTC) drug under the FD&C Act.
2. Saponification Stoichiometry & Superfatting Matrix
| Botanical Oil / Butter | Primary Fatty Acid Profile | SAP Value (NaOH mg/g) | Saponified INCI Nomenclature | Functional Role in Bar |
| :--- | :--- | :--- | :--- | :--- |
| Virgin Coconut Oil | Lauric (C12:0), Myristic (C14:0) | 0.183 g NaOH / g oil | Sodium Cocoate | Rich, fluffy lather & bar hardness |
| Raw Unrefined Shea Butter | Oleic (C18:1), Stearic (C18:0) | 0.128 g NaOH / g oil | Sodium Shea Butterate | Creamy conditioning & barrier lipid |
| Cold-Pressed Olive / Almond | Oleic (C18:1), Linoleic (C18:2) | 0.135 g NaOH / g oil | Sodium Olivate / Almondate | Silky slip & non-stripping emollience |
| Retained Plant Glycerin | Trihydroxy Sugar Alcohol | Formed in situ (~9.5%) | Glycerin | Natural humectant moisture magnet |

4. Batch Release & Labeling Compliance Checklist
-
Confirm NaOH lye concentration and 6.5% superfat buffer so zero free caustic alkali (
< 0.01%) remains after 4-week cure. -
Verify end-of-cure bar pH falls between
8.8and9.6via calibrated flat-surface pH electrode. -
Inspect paperboard unit carton for dual imperial/metric net weight (
4.5 oz / 128 g) in the lower 30% of the Principal Display Panel. - Confirm 100% of steam-distilled essential oils and botanical clays are explicitly listed on the ingredient panel.
